What Is the EB-1B Visa?

The EB-1B category is designed for outstanding professors and researchers who have achieved international recognition for their academic or scientific contributions.

 This employment-based green card category is commonly used by universities, research institutions, and qualifying private employers seeking to sponsor highly accomplished researchers, scientists, and academics.

Unlike the EB-1A category, the EB-1B requires employer sponsorship. However, it remains one of the strongest employment-based pathways because it avoids the PERM labor certification process and is generally faster than many other employment-based green card categories.

Who May Qualify

To qualify for EB-1B classification, applicants generally must demonstrate:

  • A permanent or tenure-track teaching position, or a comparable research position, from a qualifying U.S. employer.

Applicants must also typically satisfy at least 2 of the regulatory criteria, which may include:

  • Major prizes or awards;
  • Memberships requiring outstanding achievements;
  • Published material about the applicant’s work;
  • Participation as a judge of the work of others;
  • Original scientific or scholarly contributions;
  • Authorship of scholarly articles or books; and
  • Other evidence demonstrating international recognition.
